This website is owned and operated by MARTELLIER ABN 87 905 533 150, trading as Martellier(“Martellier”, “we”, “us” and “our”).

These Terms & Conditions apply to your use of our website, including any purchases made through our online store, your interaction with our content, and your use of our social media channels. By accessing our website or placing an order with Martellier, you agree to be bound by these Terms & Conditions, together with our Privacy Policy, Shipping Policy and Returns & Refund Policy.

Please read these terms carefully before using our website or completing a purchase.

1. ACCEPTANCE OF TERMS

By accessing our website, browsing our online store or purchasing from Martellier, you confirm that you:

  • are at least 18 years of age, or have the consent of a parent or guardian;
  • have read, understood and accepted these Terms & Conditions;
  • agree to comply with these Terms & Conditions; and
  • are legally able to enter into a binding agreement.

If you do not agree with these terms, you should not use our website or purchase from our store.

Martellier may update, amend or replace these Terms & Conditions from time to time. Any changes will be published on this page and will take effect from the date they are posted.

It is your responsibility to review these Terms & Conditions before using our website or placing an order. Your continued use of our website after any updates are made will be taken as your acceptance of the revised terms.

3. OUR PRODUCTS

Martellier offers women’s clothing and related fashion items designed to be worn with intention, ease and longevity.

We make every effort to display our products, colours, sizing, descriptions and details as accurately as possible. However, please note that colours may appear differently depending on your device, screen settings or lighting.

All product descriptions, pricing and availability are subject to change at any time without notice.

We reserve the right to discontinue, remove or limit the availability of any product at our discretion.

4. ORDERS

When you place an order through our website, you agree that all information provided by you is true, accurate and complete.

Once your order has been placed, you will receive an order confirmation via email. This email confirms that we have received your order, however it does not guarantee acceptance of your order.

Martellier reserves the right to cancel or refuse any order where:

  • an item is unavailable or out of stock;
  • there has been an error in pricing, product information or availability;
  • we suspect fraudulent, unauthorised or illegal activity;
  • payment has not been successfully received; or
  • the order breaches these Terms & Conditions.

If we cancel an order after payment has been made, we will issue a refund to the original payment method.

5. PRICING AND PAYMENT

All prices listed on our website are in Australian Dollars (AUD).

Prices are inclusive of GST where applicable, unless otherwise stated.

We reserve the right to update prices at any time without notice. The price charged will be the price displayed at the time your order is placed.

Payment must be made in full at checkout using one of the available payment methods displayed on our website. By completing a purchase, you warrant that you are authorised to use the selected payment method.

If payment is declined, cancelled or unable to be processed, your order may not be accepted.

6. DISCOUNT CODES AND PROMOTIONS

From time to time, Martellier may offer promotional codes, discounts or limited-time offers.

Discount codes:

  • must be used in accordance with the terms provided at the time of issue;
  • may be subject to minimum spend requirements, expiry dates or product exclusions;
  • cannot be applied retrospectively to previous orders;
  • cannot be exchanged for cash; and
  • may not be used in conjunction with any other offer unless expressly stated.

Martellier reserves the right to amend, suspend or cancel promotions at any time.

7. SHIPPING

Martellier currently ships within Australia only.

We do not currently offer international shipping.

Shipping timeframes, costs and delivery information are set out in our Shipping Policy. Delivery estimates are provided as a guide only and may be affected by factors outside our control, including postal delays, courier delays, incorrect shipping details, peak periods, weather events or other disruptions.

It is your responsibility to ensure your shipping details are accurate at the time of placing your order. Martellier is not responsible for orders that are delayed, lost or returned due to incorrect or incomplete delivery information provided by you.

8. RETURNS AND EXCHANGES

Our Returns & Refund Policy applies to all eligible purchases made through our website.

We accept returns on full-priced items within 14 days of delivery, provided the item is returned in its original condition. Items must be:

  • unworn and unwashed;
  • with all original tags attached;
  • free from makeup, perfume, marks or damage; and
  • returned in original packaging where possible.

Items that do not meet these conditions may be declined and returned to the sender.

We offer exchanges for eligible items, subject to stock availability. To request an exchange, please contact us at customercare@martellier.com.au within 14 days of receiving your order.

If your requested size or item is unavailable, a store credit may be issued instead.

Approved refunds will be processed to the original payment method. Please allow time for your bank or payment provider to process the refund once issued.

Nothing in these Terms & Conditions excludes your rights under the Australian Consumer Law.

9. FINAL SALE ITEMS

Unless required by Australian Consumer Law, final sale, clearance or promotional items may not be eligible for return, refund or exchange.

Any final sale conditions will be stated clearly at the time of purchase.

10. FAULTY OR INCORRECT ITEMS 

We take care in preparing and checking each order. If you believe you have received a faulty, damaged or incorrect item, please contact us at customercare@martellier.com.au as soon as possible with your order number and clear photos of the issue.

Where an item is confirmed to be faulty or incorrect, we will work with you to provide a suitable remedy in accordance with Australian Consumer Law.

Please note that items damaged due to normal wear and tear, misuse, incorrect washing, improper care or accidental damage may not be considered faulty.

11. PRODUCT CARE

You agree to use and care for Martellier products in accordance with any care instructions provided on the garment label, product page or packaging.

Martellier is not responsible for damage caused by improper washing, drying, ironing, storing, wearing or handling of garments.

12. ACCOUNT INFORMATION

You may be required to create an account or provide personal information to complete a purchase.

You agree to provide accurate, current and complete information and to update your details if they change.

You are responsible for maintaining the confidentiality of your account login details and for any activity that occurs under your account.

Martellier reserves the right to suspend or cancel an account if we believe these Terms & Conditions have been breached.

13. PRIVACY

Your privacy is important to us.

By using our website or placing an order, you acknowledge and agree to the handling of your personal information in accordance with our Privacy Policy.

All content on our website and social media channels is owned by, licensed to or created for Martellier. This includes, but is not limited to:

  • brand names;
  • logos;
  • product names;
  • designs;
  • imagery;
  • videos;

  • styling;
  • creative direction; and
  • other brand materials.

You must not copy, reproduce, modify, distribute, publish, sell, imitate or use any Martellier content without our prior written consent.

Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights you may have under the Australian Consumer Law or any other applicable legislation.

Where a product has a major failure, you may be entitled to a replacement, refund or other remedy under Australian Consumer Law.

21. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Martellier is not liable for any indirect, incidental, special or consequential loss, damage, cost or expense arising from your use of our website, products or services.

This includes, but is not limited to, loss arising from:

  • website interruptions or errors;
  • delays in shipping;
  • incorrect information provided by you;
  • misuse of products;
  • reliance on website content;
  • third-party service failures; or
  • unauthorised access to your account.

Where our liability cannot be excluded by law, our liability is limited to the extent permitted under Australian Consumer Law.

27. GOVERNING LAW

These Terms & Conditions are governed by the laws of Australia.

Where a dispute cannot be resolved informally, the parties agree to submit to the jurisdiction of the courts of New South Wales, Australia.
